Judge in Jalisco Suspended After Ordering the Release of a Former DIF Director Accused of Rape

The decision by a criminal oversight judge in Jalisco to modify the precautionary measure imposed on the former director of the Jalisco DIF, Lucio Miranda Robles, led to his suspension and the opening of an investigation to determine whether there were irregularities in the proceedings.

The case was made public by the president of the Jalisco Judicial Council, José Luis Álvarez Pulido, who reported that Judge Luis Ignacio Ceja Arias was temporarily removed from his duties while his conduct is under review.

Miranda Robles is currently facing charges for a sexual offense after being accused of raping a DIF employee. Due to the nature of the crime, he remained in pretrial detention.

A decision that is now under investigation.

According to judicial authorities, Judge Ceja Arias had ordered pretrial detention during a hearing held on August 12. However, he later presided over a new hearing in which he decided to modify the defendant's legal status and authorize his release.

The president of the Judicial Council noted that the ruling raised concerns among authorities, especially because, it was reported, there was no writ of habeas corpus or appeal that ordered the modification of the precautionary measure.

"He himself, the judge, ordered pretrial detention during the hearing held on August 12," explained Álvarez Pulido, referring to the background of the decision.

The judge's subsequent conduct led the Judicial Council to conclude that rules governing judicial functions may have been violated.

"On Wednesday, he presided over a different type of hearing in which, at a minimum, and without revealing details that could prejudice our administrative investigation, his conduct is considered to conflict with rules that clearly do not conform to the expected duties of a judge," the official stated.

Suspension pending determination of responsibility

The plenary session of the Jalisco Judicial Council decided to suspend the judge from his duties and initiate an administrative investigation.

This measure does not, in itself, imply that definitive responsibility has been established. The objective of the investigation will be to determine whether the judge's conduct complied with the rules and procedures governing judicial decisions.

Simultaneously, the State Attorney General's Office also opened an investigation, according to information provided by the authorities.

A case that raises questions

The decision to release the former director of the DIF (National System for Integral Family Development) has generated concern in various sectors of society, primarily because he is accused of a sexual offense and because the modification of the precautionary measure was ordered by the same judge who initially ordered his pretrial detention.

It will now be up to the relevant investigations to determine what occurred during the hearing and whether the judicial decision was based on applicable legal norms.
